Patna High Court upheld the admission of more than 100 students who took admission in MBBS in the first academic session of Radha Devi Jageshwari Memorial Medical College, Muzaffarpur in Bihar.
The Patna High Court upheld the admission of more than 100 students who were admitted in the first academic session of Radha Devi Jageshwari Memorial Medical College in Muzaffarpur, Bihar. The Division Bench of Chief Justice Justice Vinod Chandran and Justice Harish Kumar rejected all five appeals filed by the Medical Council of India and refused to interfere in the decision of the Single Bench. The Single Bench had validated the admission of over a hundred medical students for the first academic session of the year 2021-22, while approving the petition filed by the medical college.
It is noteworthy that after granting approval for 150 MBBS seats, the Rating Board team of the council had conducted a comprehensive inspection of the medical college and its hospital on November 26 and 27, 2021. In the inspection, only 42 patients were found in the desired 60 OPDs, and a shortage of teachers was found in several departments of the college. Based on this, the council issued a letter to the state government on February 15, 2022, ordering that no admission be taken in this medical college
The council was told by the state government and the medical college that after getting approval for 150 MBBS seats, admission of more than 100 students has been taken as per the rules. But rejecting the government's reply, the council canceled the admission on 18 April 2022. The permission given to the college was withdrawn. The college challenged the council's order in the High Court. The court declared the nomination correct.
